RE: The tariff classification of a barbeque grill with a refrigerator from China

Dear Ms. Williams:

In your letter dated June 15, 2009 you requested a tariff classification ruling. Descriptive literature and an illustration were submitted.

The product you plan to import is a barbeque grill with a refrigerator. This six burner (four main, one rotisserie and one side burner) gas grill is made of painted and stainless steel and also includes a side shelf and two cabinets. The left cabinet contains a gas tank tray and storage area. The 1.7 cubic foot refrigerator is located in the right cabinet directly under the grill.

The grill measures 46.75 inches x 28.5 inches x 49.75 inches. It is fueled by liquid petroleum gas or natural gas. The subject item is considered a composite good of which the essential character is imparted by the grill.

The applicable subheading for the barbeque grill with refrigerator will be 7321.11.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other cooking appliances and plate warmers for gas fuel or for both gas and other fuels. The rate of duty is free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Kenneth T. Brock at (646) 733-3009.

Sincerely,
